There needs to be a permanent investment court which will solve arguments between foreign investors and states. The upcoming treaty between the US and the EU could and should include such a court. The founding of such a court will take a lot of time dough. That is why a quick temporary solution is needed as well. This was the advice of the Advisory Board of the Dutch parlement (AIV).
The current method receives a lot of criticism. It could potentially damage the freedom of policy of states. For the time being the treaty between Canada and the EU could serve as an example.
